Terms of service

When purchasing from or using the website or services of Control Shift Escape (Pty) Ltd (referred to as “we”, “us”, “our”), now or in the future, you (the “customer”, “consumer”, “purchaser”) are agreeing to the latest Terms of Service.

These terms do contain a limitation of our liability.

1. The Basics

1.1 – You are responsible for maintaining the security of your account and password. Control Shift Escape cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.

1.2 – You may not use this website for any purpose that is unlawful or otherwise prohibited by these Terms and Conditions.

1.3 – You must be a human. Accounts registered by “bots” or other automated methods are not permitted.

1.4 – We reserve the right to terminate your account if you do not comply with the Terms and Conditions set forth on this page.

2. Pricing, Payments, Cancellation, Returns, and Refunds

2.1 - Pricing

2.1.1 – Control Shift Escape is a registered VAT vendor.

2.1.1.1 - VAT number: 4050302126.

2.1.2 – In the event of pricing errors, whether incorrectly displayed on the website or incorrectly calculated at checkout, we reserve the right to present you with the correct pricing of your order. If you do not wish to proceed with the new pricing we will offer a cancellation and refund.

2.2 - Payments

2.2.1 – We use two different PCI-DSS Level 1 Compliant payment processors (Ozow and Payfast).

2.2.2 – Payments are processed through the payment processors you select during checkout and by proceeding with your payment you are also bound to their respective Terms and Conditions.

2.2.3 – Payment of your order is passed directly to our payment processor and doesn’t ever go through our servers.

2.2.4 – We cannot and will not be liable for any loss or damage resulting from the use of our payment processors.

2.3 - Cancellations and Returns

2.3.1 – We reserve the right to cancel your order for any reason, at any time before shipping for a full refund.

2.3.2 – Per the Electronic Communications and Transactions Act of 2002 section 44, you are entitled (with exceptions and conditions per heading 2.4) to cancel without reason and without penalty any transaction and any related credit agreement for the supply of goods within seven days after the date of the receipt of the goods.

2.3.3 – If payment for the goods or services has been effected prior to a consumer exercising a right referred to in heading 2.3.2 of these terms and conditions, the consumer is entitled to a full refund of such payment, which refunds must be made within 30 days of the date of cancellation.

2.3.4 – In the event you exercise your rights per heading 2.3.2 of these terms and conditions, goods must be returned to us at your expense. If you wish for us to arrange collection we shall charge at current courier rates based on your location at the time of cancellation.

2.3.4.1 - It your responsibility to ensure your returned goods are adequately packaged for transport as to not sustain damage during typical shipment processes.

2.3.4.1.1 - Return shipments arranged by us are fully insured, with the exception where goods are damaged due to inadequate packaging.

2.3.4.1.2 - Goods of this nature may be rejected or subject to a restocking fee.

2.3.5 – Due to the automated nature of our fulfillment, orders typically cannot be canceled or modified once placed. In the event, you wish to modify or cancel your order please contact us as soon as possible. Every effort will be made to assist, however, there are no guarantees that we can accommodate your request.

2.3.6 – Orders cannot be canceled once shipped. After the order has been received you may request a return as per our return policy.

2.4 – Exceptions and conditions

2.4.1 – We cannot accept returns on any goods that have been partially or entirely disassembled, physically altered, permanently installed, affixed, attached, joined or added to, blended or combined with, or embedded within, other goods or property.

2.4.2 – If the goods are in their original condition and repackaged in their original packaging a restocking fee of up to 20% will apply.

2.4.3 – If the goods are in their original unopened packaging our restocking fee will be waived.

2.4.4 – If the goods are in an unacceptable condition we may charge for the necessary restoration costs to render the goods fit for re-stocking.

2.5 - Refunds

2.5.1 – In the event, your order is refunded, your refund will be processed to the method of payment used during checkout. If your payment method does not support refunds, we will process your refund as an EFT deposit into a bank account of your choice.

2.5.2 – Refunds can take up to, but are not limited to 7 – 10 business days to process depending on the payment method used.

3. Shipping, Insurance, and Availability of Products

3.1 - Shipping

3.1.1 – We may ship using any courier of our choice

3.1.2 – Unless special arrangements are made, we charge a flat rate for shipping and ship using any service category at our discretion.

3.1.3 – The delivery times stated on our website are estimates only and may differ based on your address, the courier's delivery schedule, or the time of year. The expected delivery time is within, but not limited to 1 – 5 business days (transit times vary by city).

3.1.3.1 – We are not responsible for delivery delays of any kind or reason.

3.1.4 – Special area surcharges may apply for some towns and areas such as mines, power stations, plots, farms, remote areas, military bases, game lodges, port/harbors, shopping malls, and embassies.

3.1.5 – In the event of a miss-quoted shipping rate or where a surcharge has not been accurately applied to the quoted price, we reserve the right to re-quote you at the correct rate before shipping.

3.1.6 – We are not responsible for lost or damaged goods on the part of a third-party recipient (see section 3.2.2).

3.1.7 - In the event, your order is undeliverable due to your inability to receive the goods or an incorrect delivery address, all additional costs incurred in delivering your order or its return to our fulfillment center will be charged to you.

3.1.8 – We require up to, but, not limited to 1 – 2 business days to process and ship your order.

3.1.9 – Some products require lead-time prior to shipping as stated on the products page or electronic correspondence.

3.1.10 – We only ship on business days (Monday to Friday).

3.1.11 – We do not ship on public holidays.

3.2 - Insurance

3.2.1 – All orders placed and shipped through our website include complimentary shipping insurance.

3.2.2 - Insurance does not cover losses or damages caused by third-party recipients.


3.3 - Availability of Products

3.3.1 – While we do our very best to ensure the availability of our products is accurately reflected on our website, in the event your products are unavailable after your order has been submitted we will contact you with alternative options or offer a cancellation and refund.

3.3.2 – We cannot and will not be liable for any loss or damage resulting from product availability or the inability to ship a product you have purchased from us.

3.4 - Pre-Order Products

3.4.1 – Pre-order products are products that are not yet available for immediate shipping. Products of this nature are indicated on their respective product pages.

3.4.2 – Estimated delivery dates for pre-order products are stated on the products page and are subject to change at any time.

3.4.3 – By purchasing a pre-order product you understand that your order and any additional products purchased within the same order will ship together on the estimated shipping date.

3.4.4 – You may cancel your pre-order product at any time before shipping for a full refund – in doing so you forfeit any reservations associated with your pre-order.

3.5 - Group-Buy Products

3.5.1 – Group-buy products are crowd-funded products where orders are only fulfilled once a minimum order quantity (MOQ) has been met. Products of this nature are indicated throughout the store with a [GB] prefix and within their respective product pages.

3.5.2 – Group-buy products can only be purchased during a limited period as stated on the products page.

3.5.3 – Group-buy products are not in-stock and do not ship immediately.

3.5.4 - Estimated shipping dates are stated on the products page, and are subject to change at any time.

3.5.5 – Group-buy orders can be canceled by us at any time, and for any reason - In the event, a group-buy order is canceled, it will be refunded as per our refund policy.

3.5.6 - Any in-stock products added with a group-buy product will ship together.

3.5.7 – By purchasing a group-buy product you understand that your order and any additional products purchased within the same order will ship together on the estimated shipping date.

3.5.8 – In the event, your group-buy product has been canceled and your order contains other in-stock products, we will refund the group-buy product/s and ship the remainder of your order.

3.5.9 – You may cancel your group-buy order at any time before shipping for a full refund – in doing so you forfeit any reservations associated with your group-buy order.

4. Warranty

4.1 – All products carry a minimum warranty of 6 months from the date of purchase.

4.2 – Manufacturer warranty applies where indicated in the product description.

4.3 – Should your product display defects within its warranty period, we shall cover the expense of having the defective goods returned.

4.4 – Within the warranty period we reserve the right to either repair or replace your defective goods.

4.5 – Should the defect be determined to have been caused by abuse or misuse of the product its warranty is void.

4.5.1 – Where a product's warranty is deemed void:

4.5.1.1 – We will quote you repair costs, and;

4.5.1.2 – You are responsible for any shipping expenses incurred for the collection and return of your defective or repaired product.

4.5.2 – In the event, your defective product is not repairable or is no longer available, for example, a limited or discontinued product, we will do our best to resolve the defect with our supplier or manufacturer. If no resolution can be achieved we reserve the right to offer you a similar product of equal value, or issue you a refund.

5. Copyright and Content Ownership

5.1 – We claim no intellectual property rights or copyrights over the brands and products we sell, promote, or market.

5.2 – This website or parts thereof including its design, logo, and content are owned by, licensed to, or approved for use by Control Shift Escape (Pty) Ltd.

5.3 – You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of this website, however, you have permission to link to, electronically copy or print hard copies of this website solely for personal, non-commercial purposes related to placing an order or shopping on this website. Unless we give you express written permission in advance, any other use of this website, its content, and information, including framing is not permitted.

5.4 – You may not modify another website or use our name or logo so as to falsely imply that it or you are associated with Control Shift Escape (Pty) Ltd.

5.5 – The use of automated data processing systems or software to extract or scrape data from our website is not permitted.

6. Links to third-party websites

6.1 – We may provide links to third-party websites for informational purposes. We claim no ownership of any third-party websites linked.

6.2 – By clicking an external link you acknowledge that Control Shift Escape has no control over the content or availability of third-party websites.

7. Changes

7.1 – We reserve the right to modify these Terms and Conditions at any time, and your continued use of our website and services is an agreement of the latest Terms and Conditions as described on this page.

7.2 – We reserve the right to modify this website and any of its contents at any time.

7.2.1 – We cannot and will not be liable for any loss or damage resulting in temporary or permanent changes to our website.

8. Liability

8.1 – You expressly understand and agree that Control Shift Escape shall not be liable, in law or in equity, to you or to any third party for any direct, indirect, incidental, lost profits, special, consequential, punitive, or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Control Shift Escape has been advised of the possibility of such damages), resulting from (i) the use or the inability to use this website; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from Control Shift Escape; (iii) unauthorized access to or alteration of your transmissions or data; (iv) or any other matter relating to these Terms and Conditions, whether as a breach of contract, tort (including negligence whether active or passive), or any other theory of liability.
